Terms & Conditions (Canada)

These Terms & Conditions (“Terms”) govern your use of Betflare websites, mobile sites, and applications (collectively, the “Services”). By creating an account or using the Services from Canada, you agree to these Terms, our Privacy Policy, Bonus Terms, Responsible Gaming Policy, and any game- or promotion-specific rules we publish (together, the “Agreement”). If you do not accept the Agreement, do not use the Services.

1) Who we are

Operator: Betflare.io is operated by Fortuna Games N.V., Dr. H. Fergusonweg 1, Curaçao, reg. no. 162413, holder of License OGL/2024/112/0974 under the National Ordinance on Offshore Games of Hazard (Curaçao).

Note for Canadian residents: these Services are offered under Curaçao licensing. Nothing herein constitutes a solicitation where local law prohibits online gaming.

2.1. You may only use the Services if you are legally permitted to do so under the laws of your jurisdiction and province/territory of residence.

2.2. Minimum legal age: You must meet the legal gambling age where you reside—19 in most Canadian provinces/territories, and 18 in Alberta, Manitoba, and Quebec. You must not use the Services if you are under the applicable legal age.

2.3. You confirm you are acting on your own behalf and not for another person or entity.

2.4. Restricted jurisdictions: Access is prohibited where online gaming is illegal or restricted, and to residents of certain countries (including, without limitation, the USA, UK, Netherlands, Spain, Ukraine, Russia, and other jurisdictions listed in our KYC/registration flow). We may update this list at any time.

3) Account creation, verification & security

3.1. You may open one account only (“Account”). Duplicate, shared, or third-party accounts are prohibited and may be closed with balance actions per these Terms.

3.2. You agree to provide accurate, current, and complete information and to keep it updated.

3.3. KYC/AML: We may request identity and address verification (e.g., passport/ID, selfie/face match, proof of address), source-of-funds/wealth information, and other checks (including sanctions/PEP screening) at any time. We may suspend or close accounts until verification is satisfactorily completed.

3.4. You are responsible for maintaining the confidentiality of your login details and for all activity under your Account. Use strong passwords and enable available security controls (e.g., 2FA).

3.5. We may refuse, suspend, or close an Account at our discretion where we reasonably suspect breach of the Agreement, fraud, money-laundering, self-exclusion circumvention, chargebacks, bonus abuse, or other prohibited conduct.

4) Deposits, gameplay & withdrawals

4.1. Deposits: We offer a range of payment methods that may vary by location. Minimum deposit amounts depend on the method used and are shown at cashier. We do not guarantee that any method will be available at all times.

4.2. Currency: Accounts for Canadian players typically transact in CAD (some back-office accounting may reflect EUR). Currency conversions (if any) use rates available to our processors; fees or exchange differences may apply.

4.3. Turnover/AML: To comply with anti-money-laundering requirements, deposited funds should be wagered a minimum of 3× prior to withdrawal unless otherwise stated. We may request additional playthrough or documentation in line with AML obligations.

4.4. Withdrawal limits: Standard payout limits are up to €5,000 per 24h, €10,000 per 7 days, €25,000 per 30 days (or CAD equivalent). Significant wins over €50,000 may be paid in €50,000 monthly tranches (jackpots paid in full as credited by the provider). Payment rails and limits may vary by method and jurisdiction.

4.5. Payment routing: Withdrawals are, where possible, returned via the same method used for deposit. You may be required to verify banking or wallet ownership.

4.6. Processing time: We aim to review withdrawals promptly; actual timelines depend on KYC status, security checks, and the payment provider. Public holidays and third-party delays are outside our control.

4.7. Inactive payment methods: We may change, add, or remove methods at any time.

5) Bonuses & promotions

5.1. Bonus offers are subject to the Bonus Terms (including wagering, max bet, game contribution, and cashout caps). In case of conflict, the Bonus Terms prevail for promotional matters.

5.2. Only one active bonus at a time unless explicitly stated. Withdrawal requests cancel previously unused bonuses.

5.3. We may modify, suspend, or withdraw any promotion at our discretion (without affecting rights already accrued under a claimed bonus).

6) Game rules, providers & fairness

6.1. You agree to the rules posted for each game. Game providers (e.g., Evolution, Pragmatic Play, Yggdrasil, Hacksaw, Nolimit City, etc.) may update rules, features, and RTPs.

6.2. RNG & Live: Slots and virtual table games use certified Random Number Generators (RNG). Live casino outcomes are determined by real-world game results.

6.3. Disconnections/malfunctions: If you disconnect mid-round, the round will normally complete on our servers; results will be available upon reconnection. Malfunction voids all pays and plays for the affected round.

6.4. Errors: Obvious pricing or settlement errors (palpable errors) are void. If a game or system outcome is incorrect due to a technical issue, we will correct the result and balances to reflect the proper outcome.

7) Responsible gaming

7.1. Please read our Responsible Gaming Policy. Tools include deposit/loss limits, session limits, time-outs, and self-exclusion.

7.2. If you self-exclude, you must not attempt to create new accounts or otherwise access the Services during the exclusion period. We may retain necessary data to enforce exclusions.

7.3. If you feel your gambling is out of control, stop playing and seek help. We can provide information about confidential support resources.

8) Prohibited conduct

You must not:

Use bots, scripts, or any automated methods.

Collude, cheat, exploit software bugs, or manipulate game states (including delaying rounds to a time with no wagering requirement).

Abuse bonuses or promotions (including multi-accounting, risk-free/arbitrage strategies, or value-banking with bonus funds).

Use stolen or unauthorised payment methods, or transact on behalf of others.

Engage in unlawful activity, money-laundering, or terrorism financing.

Harass staff or other players, or upload illegal/offensive content.

Breaches may result in suspension/closure, voiding of winnings, forfeiture and/or chargebacks, and reporting to authorities/payment networks and other operators.

9) Suspicious activity, AML & fraud

9.1. We monitor accounts for AML/CTF, fraud, and responsible-gaming indicators. We may request additional documents and suspend access while checks are ongoing.

9.2. We may share relevant information with payment providers, regulators, law enforcement, and other operators where permitted by law to prevent crime and protect the integrity of gaming.

10) Dormant & closed accounts

10.1. Dormant: If there is no login activity for 12 months, the account may be deemed dormant. We will attempt to contact you at your registered email before charging any reasonable administrative fee permitted by law (no fee will reduce balances below zero).

10.2. Closure: You may close your account at any time via Support. We may close accounts per these Terms. Any remaining real-money balance (less fees/chargebacks or amounts lawfully withheld) will be paid out via an available method subject to KYC and AML checks.

11) Intellectual property

All content, trademarks, logos, game assets, and software are owned by us or our licensors and protected by IP laws. You acquire no rights to the content other than a limited, revocable license to access and use the Services for personal entertainment.

12) Privacy & cookies

We process personal information in accordance with our Privacy Policy (Canada) and applicable laws (including PIPEDA and substantially-similar provincial statutes where applicable). Cookies and similar technologies are described in the Privacy Policy and cookie banner.

13) Liability

13.1. The Services are provided “as is” and “as available.” We disclaim all warranties to the extent permitted by law.

13.2. We are not liable for: (a) indirect, incidental, special, punitive, or consequential damages; (b) loss of data, profits, revenue, business, or goodwill; (c) delays or failures caused by networks, third-party providers, or force majeure.

13.3. Nothing excludes liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

14) Complaints & dispute resolution

14.2. Step 2 – Escalation/ADR: If unresolved, you may escalate to [email protected]. ADR is independent and aims to provide a fair review based on evidence.

14.3. Using ADR does not restrict your right to pursue remedies under applicable law.

15) Changes to the Agreement

We may amend these Terms at any time. Material changes will be posted with a new “Last updated” date. Continued use after changes constitutes acceptance. If you disagree with changes, stop using the Services and request account closure.

16) Governing law & jurisdiction

This Agreement is governed by the laws of Curaçao, excluding conflict-of-law rules. Subject to any mandatory consumer protections, you agree to the exclusive jurisdiction of the competent courts of Curaçao for disputes not resolved through support/ADR.

17) Severability & assignment

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. We may assign or transfer our rights/obligations at any time; you may not assign your rights without our prior written consent.

18) Entire agreement & language

These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and us and supersede prior understandings. The English version of these Terms prevails over translations.
